Frequently Asked Questions

What does the Firearms Law regulate, and when is a firearm possession “legal”?

The law regulates acquisition, possession, registration, carrying, manufacture, dealing in, and importation of firearms and ammunition.

Possession is legal only if you have the proper license or permit (e.g., a license to own and possess, and — if carrying outside your residence — a valid permit to carry); and the firearm must be registered and meet the law’s definitions of permitted arms.

What are the consequences if someone is found with an unlicensed or unregistered firearm?

Possession of firearms or ammunition without a valid license or permit is punishable under RA 10591.

If I’m charged with an illegal‑possession offense, what kinds of legal defenses or issues might apply?

Common defenses may include: lack of actual possession (for example, you didn’t know the firearm was present, or it was planted); lack of intent or knowledge (i.e., you were unaware the firearm was unlicensed or unregistered); or proof that you had the valid license/permit and complied with all requirements.
